1. Definitions:
The Institute - Briavel Institute
The Student- who are enrolled/ registered for courses at Briavel Institute.
“Course Materials” means the information provided by Briavel Institute to accompany a course provided as part of the Services in hard copy or electronic form.
“Fees” means the fees paid by you to Briavel Institute for the Services.
“Services” means the provision of the Online class/recorded videos and the Course Materials together with such other services as agreed from time to time and purchased by you.
“Online course” means the delivery by us of an online course pursuant to which you learn course materials remotely
“Live Class” means a course taught by us which you attend in person remotely.
“Website” means www.briavelinstitute.com
“you” means the individual purchasing the Services.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "“Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and us.
Important Information
Please read these conditions carefully as they shall form the part of the contract between the Student (If he / she is major) and the Briavel Institute. It is important that you make sure that you have read and understood all of these conditions and confirm that you accept these conditions when you enroll the Admission.
Further by admitting/enrolling your course at the Institute and by paying the requisite fees, you explicitly acknowledge that you have read & understood the terms and conditions relating to admission to the Institute (also available at the Institute’s Website at (www.briavelinstitute.com/termsconditions) and agree to abide and be bound by it. Any deficiency in the admission process cannot be pleaded as an excuse for not abiding by the terms and conditions relating to admission / payment of fees / refund / usage of student name by the Institute etc.
2. Services
We are providing the services with reasonable care and skill in accordance with the details given in the website.
We reserve the right to change or withdraw any of the Services described on the Website without notice.
We expect you to confirm that the Services you are purchasing will meet your needs. We do not make any guarantee to you that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of the Services.
2.1 Use of the Site
You agree to use the site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website.
3. Ordering the services
Purchasing Services via website or transfer the fees to account mentioned in website. you are offering to purchase the Services on these terms and conditions.
Briavel Institute reserves the right to cancel or decline your order or any part of your order at any time until it has been confirmed in accordance with below clause
- a) accepted your offer to purchase Services from us by sending you an email confirming the purchase; and
- (b) received payment of the relevant Fees from you in accordance with clause 4 below.
The receipt and confirmation of the purchase of our services send you by email.
Processing Time - All orders are processed within 7 business days. Orders are not delivered on weekends or holidays.
Briavel Institute is not responsible for any customs and taxes applied to your order. All fees imposed during or after delivering are the responsibility of the student (tariffs, taxes, etc.).
Briavel Institute does not responsible for booking any examination with any professional body or examination board. It is your responsibility to ensure that you book exam prior to the relevant closing date.
4. Fees
The training course fees include: tuition on the day(s), all relevant course materials. The Fees for the Services shall be as set out on the Website or as told to you over the telephone or email at the time you placed an order.
The fees can be paid in lump sum. The Fees are exclusive of GST or other local taxes.

Early bird discounts (15% off the course fee) and group discounts may be available on training courses. The discount is not available in conjunction with any other offer and places are subject to availability.
You shall be responsible for all costs you incur in connection with your attendance at any Online Course.
5. Liability
Briavel Institute aims to provide the highest standard Services, neither it, nor its trainers accept any liability for (i) any inaccuracy or misleading information provided in the programmes or Course Materials (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect loss arising from any breach of the terms of this Agreement.
Briavel Institute total liability arising from or in connection with these terms and conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received by us in connection with the relevant Online Course in relation to which a dispute has arisen.
No claim may be brought more than one months after the last date on which the Services concerned have finished or ceased to be provided by us.
6. Cancellation of course
we have accepted / confirmed the Services being purchased by you, then you are permitted within 15 days from purchase date to cancel your purchase of the Services other than online courses.
If you have purchased an Online Course and have already accessed, downloaded all or part of the Online Course and/or started to use that Online Course then you shall have
no right to cancel your order.
7. Refund Policy
Our Refund policy ensures that all the refunds are processed in a fair manner. In case, you have expresses to cancel the online class, we will consider for refund the amount. The refund will be processed only in “Savings Account” and not in any other type of account.
Mode of Payment of Refund:
All refunds shall be paid through Online Transfer ONLY in the name and to the account of the student within reasonable time from the date of receipt of an application for withdrawal of admission.
NOTE: The Institute shall not be held responsible and/or accountable for crediting refund money to wrong account due to incorrect details furnished by the student.
8. Intellectual Property
All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainers in the Live classes are, and remain, the intellectual property of Briavel Institute.
8.1. You are not authorised to: -
- (i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;
- (ii) record on video or audio tape, relay by videophone or other means the Online Course or live class given
- (iii) remove any copyright or other notice of Briavel Institute on the Course Materials;
- (iv) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
Breach by you of this clause 8.1 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.
8.2 In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use the Course Materials and the software in respect of the Online Course for the sole purpose of completing the Online Course and / or attending the Live class.
9. Confidentiality
9.1. Each party shall keep the other party’s Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions, and shall return it on demand and not retain copies of it.
9.2. Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.
9.3. This clause shall continue notwithstanding termination of these terms and conditions
10. Privacy Policy
Please review our Privacy Policy, which also governs your visit to Briavel Institute, to understand our practices. The personal information / data provided to us by you during usage of Briavel Institute will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations.
11. Termination
We shall be entitled to terminate these terms and conditions and cease to provide you with any Services with immediate effect in the event that you:
- a. fail to pay when due your Fees;
- b. act in an aggressive, offensive, threatening or harassing manner towards any employee of Briavel Institute, any teacher or lecturer who provides the Live class or any student who attends any Live class;
- c. In case, the teachers feel that any student is not working hard, creating indiscipline, is irregular, does not respond properly, posting or spreading wrong & negative messages / communication over social media and/or messaging platforms, then he/she may be expelled from the Institute. The decision of the institute in this regard shall be final and binding upon the student. No fee or part of the fee will be refunded in such cases.
- d. are in breach of these terms and conditions.
11.1. On termination clause 5 (liability), 8 (intellectual property rights), 9 (confidentiality) shall continue notwithstanding such termination
12. Assignment
Any Services provided by us under these terms and conditions are personal to you and cannot be transferred or assigned to any other person.
We shall be entitled to assign these terms and conditions to any other company without prior notice to you
13. Agreement
These terms and conditions, together with the Website Disclaimer and Course Specific Terms and Conditions are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with us. Nothing in this clause or terms and conditions shall limit liability for any fraudulent misrepresentation.
14. Force Majeure
Briavel Institute shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation.
15. Publicity
The institute reserves the right to use the single / group photograph(s) and name of the student for publicity in all kinds of media, if the student secures position / rank or succeeds in any professional Exams at international level at any time. In addition to the photograph, the institution also reserves the right to record video-audio testimonial of the student for the purpose of referencing or promotion, as required by the institute at any stage during and/or after the completion of the course for the purpose of publicity in all kinds of media. No separate permission will be taken from students for the same.
16. User Comments, Feedback, and Other Submissions
If, at our request, you send certain specific submissions or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.
17. Errors, Inaccuracies, and Omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to service descriptions, pricing, promotions, offers, charges, transit times, and availability.
18. Prohibited Uses
In addition to other prohibitions as set forth in the Terms and Conditions, you are prohibited from using the site or its content for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, to violate any international regulations, rules, laws, or local ordinances, to infringe upon or violate our intellectual property rights or the intellectual property rights of others.
19. Law and Jurisdiction
This Agreement is subject to Indian law and the parties submit to the exclusive jurisdiction of the Indian courts specifically District court Thrissur in connection with any dispute hereunder.
20. Disclaimer
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or dependable.
